Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Jaen Babymon app, applications, websites, and services (collectively, the "Service"), operated by Jaenworld. By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not access or use the Service.
Important: Jaen Babymon is an awareness aid, not a medical or vital-signs device. It is intended to help caregivers stay aware of a baby, and it does not replace direct adult supervision. You are responsible for keeping your devices, network, and app up to date for reliable monitoring.
License and Access
License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Jaen Babymon Service to monitor your own children or those in your care.
License Restrictions
You may not:
- Reverse engineer, decompile, or disassemble the Service
- Modify, adapt, or create derivative works of the Service
- Remove or alter any proprietary notices or labels
- Use the Service for any unlawful purpose
- Share your account credentials with others
- Resell, rent, or lease the Service without authorization
- Attempt to gain unauthorized access to any part of the Service
Subscription Plans
Access to certain features may require a paid subscription. Subscription terms, pricing, and features are detailed on our pricing page.
User Accounts
Account Creation
- You must provide accurate, current, and complete information
- You must be at least 16 years old to create an account
- You are responsible for maintaining the security of your account
- You must immediately notify us of any unauthorized access
Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.
User Content and Data
Your Content
You retain all ownership rights to the audio, video, recordings, settings, and other content captured or created through Jaen Babymon ("User Content"). By using the Service, you grant us a limited license to store, process, and transmit your User Content solely to provide the Service. Live audio and video are streamed peer-to-peer and end-to-end encrypted; we are technically unable to view or listen to that content.
Content Responsibility
- You are solely responsible for your User Content
- You must have the necessary rights to any content you upload
- You must not upload malicious code or harmful content
- You must comply with all applicable laws regarding your content
Backups
⚠️ Important: While we maintain regular backups of account data, monitoring is a real-time service and is not a guaranteed recording or storage system. Do not rely on Jaen Babymon to retain audio or video, and never rely on it as a substitute for direct adult supervision.
Acceptable Use Policy
You agree not to use the Service to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Transmit malware, viruses, or harmful code
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to other accounts or systems
- Harass, abuse, or harm other users
- Engage in fraudulent or deceptive practices
- Scrape, crawl, or use automated tools without permission
Payment Terms
Billing
- Subscription fees are billed in advance on a recurring basis
- All fees are in EUR unless otherwise stated
- Payment is due immediately upon subscription renewal
- Failed payments may result in service suspension
Refunds
Consumers in the EU and EEA have a 14-day right of withdrawal on a distance purchase under Directive 2011/83/EU. That is a legal right, not a discretionary one.
Where you ask depends on who took the payment: purchases made in the Android or iOS app are sold by Google or Apple, and Apple in particular processes those refunds itself. Full detail, with the right link for each, is on our Refunds & Cancellation page.
Price Changes
We may change our pricing at any time. Existing subscribers will be notified at least 30 days before any price increase takes effect.
Cancellation
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. No partial refunds for unused time.
Disclaimers and Limitations of Liability
Service "As Is"
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No Guarantee of Availability
We work to keep the service available, but do not guarantee uninterrupted access. We are not liable for any downtime, service interruptions, or data loss.
Not a Safety or Medical Device
⚠️ CRITICAL: Jaen Babymon is an awareness aid, not a medical or vital-signs device. It does not detect medical conditions, prevent injury, or replace direct adult supervision. Alerts and live monitoring may be delayed, interrupted, or missed due to factors outside our control, such as your network, device, battery, or operating system. You are solely responsible for the safety and supervision of any child in your care. We are not liable for any injury, loss, or damages resulting from reliance on the Service.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAENWORLD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless Jaenworld, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your User Content
Intellectual Property
The Service, including all software, designs, text, graphics, logos, and other content (excluding User Content), is owned by Jaenworld and protected by copyright, trademark, and other intellectual property laws.
"Jaen Babymon" and all related logos are trademarks of Jaenworld. You may not use our trademarks without prior written permission.
Third-Party Services and Links
The Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of third-party services. Use them at your own risk.
Governing Law and Disputes
Governing Law
These Terms are governed by the laws of Estonia and the European Union, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in the courts of Estonia.
EU Consumers
If you are a consumer in the EU, you may have additional rights under EU consumer protection laws, and nothing in these Terms shall affect those rights.
Changes to These Terms
We may update these Terms from time to time. Material changes will be notified to you via email or prominent notice in the Service at least 30 days before taking effect.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Miscellaneous
Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Jaenworld.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
